Haryana RERA Orders Godrej Properties to Deliver Delayed Flat and Compensate Buyer
Haryana RERA has ordered Godrej Properties to hand over an apartment in Tower T4 of Godrej Nature Plus in Sector 33, Sohna, which was due for possession by June 30, 2023. The authority also directed the developer to pay interest on the delayed possession, effective until the buyer receives the keys.
The Case and Timeline
The case involves buyers who booked the apartment in Tower T4 in 2018. Even after the contractual deadline had passed, possession was not offered to the buyers, who had already paid nearly ₹89.3 lakh out of the total sale value of around ₹1.2 crore.
Developer's Arguments Rejected
Godrej Properties argued that the delay was caused by recurring events such as environmental restrictions and labour shortages. However, Haryana RERA did not accept these reasons as sufficient grounds to avoid liability for the delayed possession.
The authority maintained that developers are responsible for delivering homes within the agreed timeline unless there are legally acceptable reasons for an extension.
